Federal Tort Claims Act

Community Health of South Florida, Inc. (CHI) is a Federally Qualified Health Center and is a ‘‘deemed” facility under the Federal Tort Claims Act (FTCA). The FTCA is the legal mechanism for compensating people who may have suffered personal injury by the negligent or wrongful action of employees of the U.S. Government. The FTCA provides medical malpractice coverage to all deemed facilities and its staff. The professional health care staff are considered employees of the Federal Government. A patient who alleges acts of medical malpractice by a deemed health center cannot sue the center nor the provider directly, but must file the claim against the United States Government.

FSHCAA FTCA Deemed Status Badge

BPHC has adopted a Federally Supported Health Centers Assistance Act (FSHCAA) Federal Tort Claims Act (FTCA) Deemed Status Badge. The badge can only be used and displayed in a manner that is consistent with the terms of usage by health centers that currently have been deemed as Public Health Service employees by HRSA.
